    Plaintiff, a 28 y/o male traveling on East 95th Street, Brooklyn, Kings County, when a delivery truck, having been double parked, pulled out directly into the Plaintiff’s vehicle. Plaintiff attempted to exchange information with the delivery truck driver who replied he isn’t staying and drover off. Plaintiff took down his license plate number and contact the police who issued a report indicating that the delivery drive took off but also stated there are no injuries. We filed suit on behalf of the Plaintiff and ultimately had to file an Amended Summons and Complaint when after hiring an investigator found out the parties responsible for the collision. At the time of the incident Plaintiff was employed by Delta at JFK airport as a cargo Supervisor earning $23/hour and working full time. Plaintiff went to an Urgent Care facility the same day was treated and released. He then began treatment 3 weeks later. He sustained tears and herniations to both his neck and back as well as injuries to his left wrist and left shoulder due to the force of the impact causing him to be tossed into the driver’s side door and window. He failed conservative care and had to undergo surgical repair of his rotator cuff and thereafter surgical repair of the TFCC tear in his wrist. While trying to recover from those surgeries and after several injections and months of conservative care he ultimately underwent an neck surgery with Fusion. He was unable to return to work and had to apply for and was granted Social Security Disability Benefits. No depositions were held in this case and we reached a settlement of $2.1M dollars.

    Plaintiff a 49 y/o male traveling on Carleton Avenue, Islip, Suffolk County, stopped at a stop sign, when struck in the rear by a Defendant’s vehicle a delivery truck. Police and ambulance responded to the scene. Plaintiff was taken to the emergency room where he not only complained of back pain but also reported that he urinated himself, due to the force of the impact. He sustained multiple herniated discs in both his neck and back, he was caused to undergo two spinal surgeries with fusion and hardware, under general anesthesia as well as surgery to his right shoulder, all resulting in significant permanent loss of range of motion to both his neck, back and right upper extremity, with scarring and discoloration at the operative sites. He was employed as a driver at the time of the accident and was unable to return to work. In this case Plaintiff had been involved in a prior motor vehicle incident wherein he sustained an injuries to both his shoulder and lower back, further he was a bystander who sustained a bullet wound to his lower back, which had required surgical intervention, but they were unable to remove all of the fragments, which left him with occasional abdominal and lower back pain. This case was in suit and we made a motion for Summary Judgment on the issue of liability. While the motion was pending, the parties agreed to attempt to resolve this matter through mediation. At the Mediation this matter was settled for $1.7M.

    Plaintiff a 61 y/o male, electrical engineer, traveling on Veterans Memorial Highway, Islip, Suffolk County, in the far-right lane, was struck by Defendant also traveling in the same direction as Plaintiff, in the far-left turn, decided they missed the exit and crossed over 4 lanes, striking Plaintiff’s vehicle. Police responded and the Plaintiff complained of neck pain but declined an ambulance. He never went to the hospital or an Urgent Care facility but began Chiropractic treatment 2 days after the incident. He then began treating with a neurologist due to continued headaches, blurred vision, hearing loss, anxiety disorder all attributed to a Traumatic Brain Injury. In addition, he sustained herniations in both his neck, middle and lower back, requiring injections in his neck and lower back and ultimately underwent spinal surgery. Due to the severity of his pain, he was unable to work for three months immediately following the incident and then again for a month following his spinal surgery. We commenced a lawsuit and prior to depositions made a motion for summary judgment on the issue of liability which was opposed by the defendant who disputed the layout of the roadway and the way in which the accident occurred. The Court dismissed the Defendant’s allegations and granted our Motion for Summary Judgment on the issue of Liability. The Plaintiff then appeared for an oral examination where he was questioned at length about his injuries. Defendant then appointed a doctor to examine the Plaintiff to determine the extent of his injuries. Plaintiff has requested a copy of the notes emanating from the examination, which the Defendant’s refused to provide. A motion was made to compel the exchange of this information. Before the motion was decided, this matter was settled for $1.1M dollars.

    Plaintiff a 29 y/o female, employed as a program facilitator in Chapel Hill, South Carolina, on vacation in New York from SC. She was exiting a clothing store in Brooklyn, Kings County, when she was caused to trip and fall due to improperly installed entrance/exit door which extended over a narrow step as you exited the store onto the sidewalk outside the premises. She was taken by ambulance to the hospital where she was immediately taken into surgery and had a plate and screws inserted into her left ankle. We hired an investigator to take photographs of the accident site and obtain the property information to determine the owner of the premises and then we hired an engineer to determine the New York City code violations. Our client had to make special accommodations to return home and continued to treat at Duke Hospital. We placed this matter into suit and after the Preliminary Conference settled this matter for $460K.
